Construction and repair by own hands

Distance from houses to the roadway. How far from the road can I build a store

Currently, there are a lot of different norms that regulate construction issues. At first glance this looks like excessive bureaucratization. But actually it is not.

After all, in life there are often controversial situations associated with construction. For example, when neighbors suddenly decide to move the fence closer to the road. What norms are in effect in this case and what other controversial cases are regulated, we will discuss in this article.

Space from fence to road

This interval is determined by the relevant authorities. The owner of the land plot, having formalized his rights under the law, can not worry about anything.

In this case, everything is simple. A person in the property has a plot of land. And on its border from the side of the road the owner has every right to put up his fence.

What is the distance from the fence to the roadway, it does not matter. After all, there is a certificate of ownership and a plot of land.

But, unfortunately, this is not always the case. Quite often there are cases of land squatting. This means the following. The owner of the land simply moves his fence closer to the road, without making out any documents at the same time.

This falls under the rules that establish administrative responsibility for unauthorized occupation of the land. The offender is then fined, according to Article 7.1 of the Code of Administrative Offenses.

In order to bring the offending partner to justice, one must apply to the local administration with a complaint. It carries out the functions of municipal land control. And, accordingly, will be obliged to take administrative measures, since the distance from the site to the road was illegally reduced.

But there is also a legal way of moving the border. To do this, it is necessary to buy land from the state in the manner provided for in Article 34 of the Land Code.

That is, you need to contact the local administration with the appropriate application. In a month you will receive a written response.

In case of positive reaction of the local authority, it will be possible to proceed to land registration. But at the same time, of course, all the attendant costs you will pay at your own expense.

Advice! To avoid unnecessary loss of time in the clearance process, it is worthwhile to hire a realtor. He will solve all paper issues related to the acquisition of land. You, in the meantime, will be able to deal with more important issues.

But there is one important point. You can only buy the land that is located before the red line of the street.

This is the name of the conventional line, which separates the road from other types of land. You can find it only on special maps. And strictly speaking, the distance from the fence to the road in the village ends exactly on this line.

Other norms

Distance to gas pipeline

Also disputable questions concerning distances can arise and at a lining of engineering communications. For example, a gas pipeline.

In the legislation there is such a thing as a security zone. This is the name of a territory with a special mode of use around any important engineering facilities.

A special mode of use means that other objects are not allowed in this zone. And any land works are possible only with the consent of authorized bodies.

The security zone of the underground gas pipeline was established by the Government of Russia. On this occasion, there is a decree of November 20, 2000, numbered 878.

According to this document, the protection zone for the underground gas pipeline is 2 m. Accordingly, the distance from the fence to the gas pipeline should not be less than this value.

Distance to water supply

Legislation regulates the order of location of the water supply system with respect to other facilities. Such norms are fixed in SNiP 2.07.01-89.

In particular, this document establishes that the water pipe must pass no closer than 2m from the tree trunks. In addition, such networks are located at a distance of at least 5 m from the foundations of buildings and structures.

The space from the paved pipes to the edge of the roadway must be at least 2 m. And the gap to the foundations of fencing enterprises, as well as overpasses, communication towers and railways - 3m.

There is one interesting point. With respect to the gap from the water pipe to the fence of the residential building, the necessary norm is absent.

But, as practice shows, the municipal services use the above-stated standard, equal to 3 m when laying pipes. Therefore, when answering the question of what the distance from the water pipe to the fence should be, it is necessary to be guided by this figure.

Distance from fences to buildings

There is another interesting document called SNiP 30-02-97. It establishes the minimum values of distances from the fence to various structures:

  •   should be from 3m. This interval, as the instruction says, is measured from the fence and to the socle.

But there is one exception. If any element of the structure protrudes forward from half a meter and more, then it begins to be measured from it;

  •   should be from 1m. Moreover, the roofs of these buildings must have a ramp not to their neighbor, but to their own site;
  • buildings containing various poultry must be at a distance of 1 m from the fence;
  • from the hedge to the planted shrubs should be a gap of 1m, to trees of medium height - from 2m, to trees with a large height - from 4m;
  • the distance from the toilet to the house belonging to the neighbors is not less than 12 m. The gap from the bath that belongs to you, up to their house - 8m. In the case of objects on your site, all the values indicated will be the same (see photo);
  • from your garage to the neighboring fence - a minimum of 1m.

The optimal version of the gaps between poles is from 2.5m to 3m. There are fences with spans and up to 6 m in length. But these are single specimens, which most often refer to brick fences or to structures made from corrugated board.

We hope that the information provided here was useful to you. If you need additional explanations about the described norms, you can find them in the video posted on our website.

Lawyer's answer

Question:

I live on the Yaroslavl highway in a four-story building. This summer it was decided to expand the highway and lay an additional strip towards the center. One of the lanes of the huge highway will pass in 2 (!) Meters from the house   in which I live and many more people.

Do officials have the right to make such decisions and build a road so close to the residential building?

Igor.

Lawyer's answer:

In accordance with clause 6.9 and clause 6.19. SNiP 2.07.01-89 Motor roads of the general network of I, II, III categories, as a rule, should be designed around the settlements in accordance with SNiP 2.05.02-85. Distances from the edge of the roadway of these roads prior to construction should be taken in accordance with SNiP 2.05.02-85 and the requirements of section. 9 of these standards, but not less: to residential buildings 100m, to horticultural associations 50m; for Category IV roads should be taken respectively 50 and 25 m. To protect the building from the noise and exhaust gases of cars, it is necessary to provide along the road a strip of green plantations with a width of at least 10 m. The distance from the edge of the main thoroughfare of the main roads to the line for regulation of residential development should be taken at least 50 m, and if noise-protective devices are provided that meet the requirements of SNiP 11-12-77, at least 25 m. The distance from the edge of the main carriageway of streets, or lateral driveways to the building line should take no more than 25 m. In the cases of exceeding this distance, a strip of 6 m wide, suitable for the passage of fire engines, should be provided at a distance no closer than 5 m from the construction line. Streets and intradominal thoroughfares must be carried out in accordance with the norms of TCH 45-3.03-227-2010 "Streets of settlements. Construction standards of design. " The distance from the edge of driveways and pedestrian paths to the building wall should generally be taken from 5 to 8 m. - for buildings up to 9 floors high and from 8 to 10 m for buildings of 9 floors or more. Passages should be provided from two longitudinal sides of multi-section buildings and from all sides of single-storey multi-storey buildings (paragraph 5.3.12).

That is, laying a road at a distance of 2 meters from your house is illegal.

Therefore, you have the right to file an individual or collective complaint with the prosecutor's office and the court. I can provide a service for drafting a justified complaint and a lawsuit.

The urban development is getting denser every year. This fact pushes many townspeople to purchase their own house. Closed territory gives confidence in the security of your home. However, this issue also requires careful and in-depth study. This will prevent conflicts with the owners of neighboring sites, to fulfill the conditions necessary for the construction site to the maximum extent.

An integral part of every private house is a fence. It makes the site as comfortable and comfortable as possible. However, its erection is accompanied by the need to comply with strict rules and established norms. This parameter, like the distance between the road and the fence, is paid close attention to the Building Regulations and Rules (SNIP).

Distance requirements according to the rules

SNIP are a set of normative documents and acts that reflect the requirements for construction regulations.

Fence construction is established according to the established boundaries of the plot of land. Certain rules indicate exactly what the distance between the fence and the road should be. The change in distance is an administrative offense for which punishment is established.

The established boundaries are defined on the general plan available to the local government bodies. In the process of drawing up the plan, land surveyors, as well as surveyors, participate. In accordance with the information of this plan, documents are processed for the site, when a sale transaction, donations or any other, allowing to formalize the property in the property.

Most often, as a material for the fence during its erection, is selected. The greatest demand is enjoyed. In its manufacture, mainly metal is used, which has a high level of resistance to corrosion and changes in atmospheric conditions.

SNIP is designed to regulate the necessary distance, which must be retreated from the road when building a fence, with the observance of fire safety rules, established regulations, rules. The following should be distinguished:

    Road - a territory that also includes curbs and tracks for pedestrians;

    The roadway does not have roadside structures.

This can explain that the distance from the roadway to the road must be greater than between the fence and the road. Examples include rural settlements where the road, including the pedestrian zone, as well as the roadside, is much wider. The width of the sidewalks, as a rule, is about one and a half meters.

In life, the following method is often used. According to the established norms, the distance between the road and the fence should be about two meters. The distance to the roadway is five meters. These parameters are established as necessary, they correspond to fire and sanitary requirements

Requirements for the distance between the fence and the road in the village

Quite common are situations where in villages or in the territory of horticultural associations local governments give permission to build a fence at a distance from the road that is less than two meters. However, it is not recommended to agree with such a resolution. In the event that there is a car, then too little distance between the road and the fence can create significant problems when leaving its territory.

See the video below about the boundaries of the plot at the planning stages.

In addition, it should be taken into account that the fence is not an obstacle for pedestrians and does not interfere with the passage of vehicles. There are cases when owners of plots are given the opportunity to purchase 2-3 meters of land in addition, which allows you to transfer the boundaries of the plot. The difficulty here is the need to buy land directly from the state.

In the event that the document of the owner determines that the boundaries of the land plot under its ownership pass along the boundaries of the road, the place of erection of the fence does not matter. The owner of the site in the right to independently install the location of the fence. The most important thing is that its location does not become an obstacle to the movement of pedestrians and does not interfere with driving cars
