Recognize as illegal the actions of the head of the Main Organizational and Mobilization Directorate of the General Staff of the Armed Forces of the Russian Federation (hereinafter referred to as GOMU General Staff of the RF Armed Forces), related to the issuance of order No. 302 dated November 29, 2011 regarding his exclusion from the lists of personnel of the department, and the order itself is illegal and not valid from the moment of its publication;

Oblige the head of the Main Directorate of the General Staff of the Armed Forces of the Russian Federation to restore him to the lists of personnel of the department and recalculate all types of allowances as of the date of the court decision;

Oblige the head of the Federal Budgetary Institution “Financial Support Directorate of the Ministry of Defense of the Russian Federation for the city of Moscow and the Moscow Region” to recalculate his monetary allowance, including a one-time monetary reward for conscientious performance of military service duties, as of the date of reinstatement in the lists of department personnel;

Oblige the Chief of the General Staff of the Armed Forces of the Russian Federation to identify a military command body that will provide him with clothing.

In support of the stated requirements, Repin A.G. In his statement, he indicated that on the basis of the order of the Minister of Defense of the Russian Federation on his dismissal from military service, the head of the Main Directorate of the General Staff of the Russian Armed Forces issued an order to exclude him from the lists of personnel of the department from December 14, 2011. As of this date, contrary to the requirements of the current legislation, he was not provided with allowance for December 2011, a one-time monetary reward for conscientious performance of military service duties for 2011 and a one-time monetary allowance upon dismissal from military service, as well as clothing allowance. He did not give consent to be removed from the lists of the military unit’s personnel until final settlement of the required types of allowances was made with him.

Repin A.G. supported the stated demands and explained that the need to arrive at the Main Military Directorate of the General Staff of the Russian Armed Forces to receive clothing in connection with his exclusion from the lists of unit personnel was communicated to him on December 27, XXXX by an employee of the military commissariat during a telephone conversation. However, he did not stay at the Main Military Directorate of the General Staff of the Armed Forces of the Russian Federation, since he filed a real statement in court. Next Repin A.G. explained that vacations for 2011 were provided to him in full. He was provided with the required monetary allowance in full on December 16, 2012. To this day he has not been provided with clothing.

The representative of the head of the GOMU General Staff of the RF Armed Forces did not recognize the applicant’s demands and explained that the order of the Minister of Defense of the Russian Federation dated September 30, 2011 No. 1150 on the dismissal of the applicant from military service was received by the GOMU General Staff of the RF Armed Forces on October 7, 2011. By order of the Chief of the Main Directorate of the General Staff of the RF Armed Forces dated November 29, 2011 No. 302 Repin A.G. after providing the required leave, he was removed from the lists of department personnel from December 14, 2011. This order was communicated to the applicant by the responsible official, Lieutenant Colonel A.S. Efremov. December 11, 2011. At the same time, Lieutenant Colonel Efremov A.S. informed the applicant of the need to come to the department to obtain an extract from the said order, that Repin A.G. was not done. The calculation of the applicant's clothing property due for issuance was made by the 1st support department of the Clothing Service of the central apparatus of the Ministry of Defense of the Russian Federation on January 13, 2012. To receive this property, Repin A.G. you must contact the specified department.

The head of the Federal Treasury Institution “Unified Settlement Center of the Ministry of Defense of the Russian Federation”, duly notified of the place and time of the court hearing, did not arrive at the court session. From the representative of the said official to the court, along with written objections regarding the stated requirements of Repin A.G. a petition was received to consider the civil case without his participation. In her objections, the representative of the head of the Federal State Institution “Unified Settlement Center of the Ministry of Defense of the Russian Federation” indicated the following. Military personnel of the central apparatus of the Ministry of Defense of the Russian Federation have been enrolled in financial support at the Federal State Institution “Unified Settlement Center of the Ministry of Defense of the Russian Federation” since October 1, 2011. All due payments to Repin A.G. accrued and transferred in full. The applicant did not submit a certificate on the basis of which compensation for property is paid to the Federal State Institution “Unified Settlement Center of the Ministry of Defense of the Russian Federation”. In addition, the debt in itself to pay compensation for clothing cannot serve as an unconditional basis for the reinstatement of a serviceman in the lists of the unit’s personnel, but is subject to assessment in the aggregate volume of the implementation of the rights of this person, taking into account the possibility of eliminating the violations in full without reinstatement the specified lists.

From the head of the 1st support department of the Clothing Service of the central apparatus of the Ministry of Defense of the Russian Federation, who was duly notified of the place and time of consideration of the application, the court received a written petition to consider the civil case without his participation.

The Chief of the General Staff of the Armed Forces of the Russian Federation and the head of the Federal Budgetary Institution "Financial Support Directorate of the Ministry of Defense of the Russian Federation for the City of Moscow and the Moscow Region", duly notified of the place and time of consideration of the application, did not come to the court hearing, did not send their representatives, The reasons for failure to appear in court were not reported.

Having heard the explanations of the applicant, the representative of the head of the GOMU General Staff of the RF Armed Forces, the conclusion of the prosecutor, who considered it necessary to oblige the head of the GOMU General Staff of the RF Armed Forces to amend order No. 302 of November 29, 2011 regarding the exclusion of the applicant from the lists of department personnel from December 14 to 16, 2011, and also oblige the relevant officials provide him with monetary allowance and clothing until the new exclusion date, refusing to satisfy the applicant’s demands in the rest, having examined the evidence in the case, the court comes to the following conclusions.

In accordance with an extract from the order of the Minister of Defense of the Russian Federation dated September 30, 2011 No. 1150, Colonel of Justice A.G. Repin discharged from military service and enlisted in the reserves due to organizational and staffing measures. The length of service in calendar terms was 29 years 10 months.

According to a copy of the order of the head of the GOMU of the General Staff of the RF Armed Forces dated November 29, 2011 No. 302, Colonel of Justice A.G. On December 14, 2011, he was excluded from the lists of personnel of the Main Military Directorate of the General Staff of the Russian Armed Forces. By the same order, Repin A.G. a one-time monetary benefit upon dismissal from military service was established in the amount of 171,100 rubles, a one-time monetary reward for conscientious performance of military service duties for 2011 in the amount of 23,526 rubles, monetary compensation for lost items of clothing property, the right to which arose during the last 12 months.

A copy of Repin A.G.’s payslip for December 2011 and an extract from the contract of the client "VTB24" (CJSC) confirms that the payment of monetary allowance for the period from December 1 to December 14, 2011, as well as a one-time monetary benefit upon dismissal from military service and a one-time monetary reward for the conscientious performance of military duties services for 2011 were made to the applicant by transferring funds to his current account on December 16, 2012.

According to the message of the head of the 1st support department of the Clothing Service of the central apparatus of the Ministry of Defense of the Russian Federation dated February 29, 2012, No. 7, an extract from the order of the head of the Main Military Directorate of the General Staff of the Russian Armed Forces dated November 29, 2011 No. 302 on the expulsion of Colonel A.G. Repin. from the lists of personnel of the department, it was received by the 1st support department of the Clothing Service of the central apparatus of the Ministry of Defense of the Russian Federation in December 2011. In accordance with the directive of the Minister of Defense of the Russian Federation dated September 20, 2011, No. XXX, the Clothing Service (the central apparatus of the Ministry of Defense of the Russian Federation and military units of central subordination) was disbanded on December 1, XXXX. In this regard, for objective reasons (liquidation measures were carried out), the supply of clothing to military personnel was temporarily suspended. On January 10, 2012, the service was re-formed under the subordination of military unit 96129. On January 13, 2012, Colonel A.G. Repin the calculation was made - the following was issued: certificate for receipt of monetary compensation No. 7/3 dated January 13, 2012 in the amount of 10,331 rubles 70 kopecks; invoice No. 8/3 dated January 13, 2012 for the rest of the clothing property due for delivery. Repin A.G. To date, I have not applied to the 1st supply department of the Clothing Service of the central apparatus of the Ministry of Defense of the Russian Federation to receive clothing property. To receive this property, he must come to the specified department.

By virtue of Articles 2, 12, 13, 14 of the Federal Law of the Russian Federation of May 27, 1998 No. 76-FZ “On the status of military personnel,” military personnel during military service must be provided with monetary and clothing allowances, as well as additional payments.

According to paragraph 11 of Article 38 of the Federal Law of March 28, 1998 No. 53-FZ “On Military Duty and Military Service”, the end of military service is considered the date of exclusion of a serviceman from the lists of personnel of a military unit.

In accordance with paragraph 16 of Article 34 of the Regulations on the procedure for military service, approved by Decree of the President of the Russian Federation of September 16, 1999 No. 1237, a serviceman dismissed from military service, on the day of exclusion from the lists of personnel of a military unit, must be fully provided with the established monetary allowance , food and clothing supplies. Until all final settlements are made with the serviceman, he is not excluded from the lists of personnel of the military unit without his consent.

Thus, as established at the court hearing, by order of the Minister of Defense of the Russian Federation dated September 30, 2011 No. 1150, Colonel of Justice A.G. Repin was dismissed from military service in connection with organizational and staffing measures, and by order of the head of the Main Directorate of the General Staff of the Russian Armed Forces dated November 29, 2011 No. 302, he was excluded from the lists of department personnel on December 14, 2011. The applicant did not give his consent to be removed from the lists of personnel of the military unit without making a final payment to him for the required types of allowance. At the same time, contrary to the requirements of paragraph 16 of Article 34 of the said Regulations on the procedure for military service, the final settlement with the established monetary allowance with A.G. Repin. made by transferring funds to his current account only on December 16, 2011, that is, after he was removed from the lists of personnel. On the same date, a one-time monetary allowance upon dismissal from military service and a one-time monetary reward for conscientious performance of military service duties for 2011 were transferred to him by the head of the Main Directorate of the General Staff of the RF Armed Forces. The final settlement of clothing allowances with the applicant has not been made to date.

Also at the court hearing, it was established that the military personnel of the Main Military Directorate of the General Staff of the Armed Forces of the Russian Federation are on financial support in the Federal Treasury Institution “Unified Settlement Center of the Ministry of Defense of the Russian Federation”, and on clothing support - in the 1st department of the clothing service of the central apparatus of the Ministry of Defense of the Russian Federation.

Since the final settlement of the monetary allowance and the above-mentioned one-time additional payments with the applicant was made due to circumstances beyond his control only on December 16, 2011, the court, taking into account the requirements of paragraph 16 of Article 34 of the Regulations on the procedure for military service, which provides for providing the serviceman with all required types of allowance for day of exclusion from the lists of personnel, in order to restore the rights and legally protected interests of the applicant, he considers it necessary to recognize as illegal the actions of the head of the Main Directorate of the General Staff of the RF Armed Forces related to the issuance of Order No. 302 dated November 29, 2011 regarding his exclusion from the lists of department personnel from December 14, 2011 , to oblige the head of the GOMU of the General Staff of the Armed Forces of the Russian Federation to amend the order of November 29, 2011 No. 302 regarding his exclusion from the lists of personnel of the department from December 14 to 16, 2011, to oblige the head of the Federal Treasury Institution “Unified Settlement Center of the Ministry of Defense of the Russian Federation” to pay him monetary allowance until December 16, 2011, oblige the head of the 1st support department of the Clothing Service of the central apparatus of the Ministry of Defense of the Russian Federation to make a final settlement with him in clothing allowance until December 16, 2011, thereby satisfying the stated demands of Repin A.G. in this part.

For the same reasons, the court refuses to satisfy the applicant’s demands to recognize the order of the head of the Main Directorate of the General Staff of the Armed Forces of the Russian Federation dated November 29, 2011 No. 302 regarding his exclusion from the lists of personnel of the department as illegal and not valid from the moment of its publication, imposing duties on the head of the Main Directorate of the General Staff of the Armed Forces of the Russian Federation to restore him in the lists of personnel of the department and to carry out recalculation of all types of allowances on the date of the court decision, assigning responsibility to the head of the Federal budgetary institution "Financial Support Directorate of the Ministry of Defense of the Russian Federation for the city of Moscow and the Moscow region" to recalculate his monetary allowances, including a one-time monetary reward for conscientious performance of military service duties, on the date of reinstatement in the lists of department personnel.

As for the applicant’s argument that he has not been provided with property to date, the court comes to the conclusion that in this case, the restoration of the rights and interests of the applicant protected by law is possible by assigning the responsibility to the head of the 1st support department of the Clothing Service of the central apparatus of the Ministry of Defense of the Russian Federation to make a final settlement with him in clothing allowance on the new date of exclusion from the lists of department personnel.

Since, as noted above, the military personnel of the Main Military Directorate of the General Staff of the Russian Armed Forces, who provide clothing support, are in the 1st supply department of the Clothing Service of the central apparatus of the Ministry of Defense of the Russian Federation and the head of this department is entrusted with the responsibility for making the final settlement with the applicant in clothing allowance, the court finds no grounds for satisfying his demands to assign responsibility to the Chief of the General Staff of the Armed Forces of the Russian Federation to determine the military command body that will provide him with clothing.

In accordance with Article 98 of the Code of Civil Procedure of the Russian Federation, the party in whose favor the court decision was made is awarded to reimburse the other party for all legal costs incurred in the case.

Since the statement of Repin A.G. is subject to partial satisfaction, then the legal expenses incurred by him to pay the state fee when applying to the court with an application in the amount of 200 rubles are subject to recovery in his favor from the Federal Treasury Institution “Unified Settlement Center of the Ministry of Defense of the Russian Federation.”
